Prescription Fraud Cases

A subset of cases based on violations of the controlled dangerous substance laws are cases involving forged prescriptions. Forged prescriptions are most commonly used in an attempt to acquire pain medication such as Oxycodone or anti-anxiety medications such as alazopram, also known as Xanex. The illegal use of prescription drugs has reach epidemic proportions in Maryland and law enforcement is responding aggressively. Many police agencies have set up special investigation divisions dedicated to these cases and arrests are increasing exponentially and prosecutors are seeking harsher penalties. Moreover, while these cases were previously almost always charged as prescription fraud cases only, detectives assigned to these special units are now routinely stretching the facts of these cases to justify charging them as felony possession with the intent to distribute charges. This can subject some defendants to the long mandatory sentences discussed in the drug case section above and even in cases where it does not it certainly increases the stakes for the defendant who is so charged.
